Resumen. Se examina sumariamente la regulación sobre el teletrabajo existente en España y en Italia; en particular, respecto de este país, la novedosa figura denominada “lavoro agile” contenida en la Ley 81/2017. La comparativa se realiza sobre la finalidad y el concepto legal definido en cada uno de los ordenamientos, los requisitos formales del pacto de teletrabajo y los derechos y obligaciones que componen su régimen jurídico. Tras la comparativa, se analiza críticamente la regulación de cada país, finalizando con unas conclusiones aplicables a la regulación del teletrabajo en general y la necesidad de una “actualización” de la normativa existente.
Spanish Telework and Italian “agile” work: a comparison
Summary. The regulation on telework existing in Spain and Italy is summarily examined, in particular the novel concept in Italy called “agile work”, contained in Law 81/2017. A comparison is made of the purpose and legally defined concept in each of the legislations, the formal requirements of a telework agreement, and the rights and responsibilities that make up their legal regime. Following the comparison, the regulations in each country are critically analyzed, finishing up with some conclusions applicable to the regulation of telework in general, and the need for an “update” of existing regulations.
